Wellness Amenities Acknowledgment & Assumption of Risk

MOSÉ — My Own Spa Experience is designed around private, self-directed wellness experiences. Depending on the accommodation reserved, amenities may include infrared saunas, traditional or outdoor saunas, steam rooms, cold plunges, hot tubs, wood-fired hot tubs, outdoor showers, massage equipment, aromatherapy, chromotherapy, wellness programming, and other wellness or relaxation amenities.

Please read this acknowledgment carefully before using any MOSÉ wellness amenity.

1. VOLUNTARY PARTICIPATION

I understand that my use of MOSÉ wellness amenities is entirely voluntary.

I may choose whether to use an amenity and may stop using an amenity at any time.

I understand that I am responsible for using reasonable judgment regarding my own physical condition and ability to participate safely.

2. MOSÉ DOES NOT PROVIDE MEDICAL CARE

I understand that MOSÉ is a hospitality and wellness-experience business and is not a medical provider.

MOSÉ does not diagnose medical conditions, prescribe treatment, determine whether an activity is medically appropriate for me, or provide medical advice.

Any wellness information, programming, instructions, or suggestions provided by MOSÉ are for general informational or operational purposes and are not a substitute for professional medical advice.

3. HEALTH CONSIDERATIONS

I understand that heat exposure, cold exposure, rapid temperature changes, immersion in water, steam, and other wellness activities may place stress on the body.

Certain activities may not be appropriate for everyone.

If I am pregnant, have cardiovascular or circulatory conditions, blood-pressure concerns, respiratory conditions, neurological conditions, impaired temperature regulation, a history of fainting or seizures, or another medical condition that could affect my safe participation, or if I take medication that may affect blood pressure, circulation, alertness, hydration, or heat or cold tolerance, I understand that I should consult an appropriate medical professional before participating.

If I am uncertain whether an activity is appropriate for me, I will not participate until I have obtained appropriate medical guidance.

4. HEAT EXPOSURE

Saunas, steam rooms, hot tubs, wood-fired hot tubs, and other heated environments can expose the body to elevated temperatures.

I understand that potential risks can include overheating, dehydration, dizziness, fainting, changes in blood pressure, falls, burns, and other adverse physical reactions.

I agree to follow posted instructions and temperature or time guidance.

I will leave a heated environment immediately if I experience dizziness, nausea, weakness, confusion, difficulty breathing, unusual discomfort, excessive heat, or any other concerning symptom.

5. COLD EXPOSURE

Cold plunges and other cold-immersion experiences expose the body to sudden and significant cold.

I understand that cold exposure can cause an immediate physiological response and may affect breathing, heart rate, circulation, coordination, and blood pressure.

I will enter and exit carefully, will not exceed posted recommendations, and will discontinue use immediately if I experience unusual difficulty breathing, chest discomfort, dizziness, confusion, numbness, weakness, loss of coordination, or other concerning symptoms.

6. TRANSITIONING BETWEEN HEAT AND COLD

I understand that voluntarily moving between heated and cold environments can create additional physiological stress.

I will use reasonable judgment, follow MOSÉ instructions and posted guidance, allow appropriate recovery when needed, and stop participating if I feel unwell.

7. WATER, WET SURFACES AND OUTDOOR AREAS

Hot tubs, cold plunges, showers, steam rooms, decks, steps, pathways, and other wellness areas may become wet or slippery.

Outdoor areas may also be affected by weather, moisture, uneven terrain, insects, wildlife, darkness, and natural conditions.

I agree to exercise reasonable care when entering, exiting, or moving around these areas and to use available handrails, steps, lighting, and other safety features where appropriate.

8. WOOD-FIRED AND OUTDOOR EQUIPMENT

Certain MOSÉ accommodations may include wood-fired or outdoor wellness equipment.

I understand that these amenities may involve hot surfaces, heated water, fire or heat sources, changing temperatures, smoke, outdoor conditions, and other risks inherent in this type of equipment.

I agree to follow all operating and safety instructions provided by MOSÉ and not to modify, bypass, disable, or misuse safety equipment or operating controls.

I will not attempt repairs or alterations.

If an amenity appears damaged, unsafe, improperly operating, or unusually hot, I will discontinue use and notify MOSÉ.

9. ALCOHOL, IMPAIRMENT AND WELLNESS AMENITIES

MOSÉ permits lawful alcohol consumption by guests of legal drinking age.

However, I understand that alcohol and other substances that impair judgment, balance, hydration, alertness, blood pressure, or temperature regulation can increase the risks associated with saunas, steam rooms, hot tubs, cold plunges, water, and other wellness amenities.

I agree not to use a wellness amenity when I am impaired or when alcohol, medication, or another substance makes its use unsafe.

10. FOLLOWING SAFETY INSTRUCTIONS

I agree to follow posted instructions, operating instructions, warnings, occupancy limitations, temperature guidance, time recommendations, and reasonable safety directions provided by MOSÉ.

I will not intentionally disable safety devices, tamper with equipment, misuse an amenity, or use an amenity for a purpose for which it was not designed.

11. STOPPING USE AND REPORTING PROBLEMS

I understand that I should immediately stop using an amenity if I experience pain, dizziness, faintness, confusion, breathing difficulty, chest discomfort, nausea, excessive heat or cold, unusual weakness, loss of coordination, or another concerning physical reaction.

If I believe I or another person may be experiencing a medical emergency, I will call 911 or obtain appropriate emergency assistance rather than relying solely on electronic communication with MOSÉ.

I will promptly notify MOSÉ if an amenity appears damaged, unsafe, or malfunctioning.

12. ASSUMPTION OF INHERENT RISKS

I understand that even when wellness amenities are properly maintained and used according to instructions, some risks are inherent in activities involving heat, cold, water, steam, outdoor environments, physical movement, and transitions between temperatures.

By voluntarily choosing to use these amenities, I acknowledge and assume the ordinary and inherent risks associated with those activities, to the extent permitted by applicable law.

I understand that this acknowledgment does not excuse MOSÉ from responsibilities or liabilities that cannot lawfully be waived.

13. RESPONSIBILITY FOR OTHER MEMBERS OF MY PARTY

I understand that every adult guest is responsible for making appropriate decisions concerning their own use of MOSÉ wellness amenities.

As the person making the reservation, I agree to communicate MOSÉ's applicable safety rules and wellness requirements to the other members of my party.

Where MOSÉ requires an individual acknowledgment from another adult guest, that guest must complete it before using the applicable amenities.

14. EMERGENCIES

In an emergency, guests should call 911.

Guests should not delay emergency assistance while attempting to contact MOSÉ.

MOSÉ should also be notified as soon as reasonably practical so that we can respond appropriately to conditions at the property.

15. ACKNOWLEDGMENT

By providing the required electronic acknowledgment, I confirm that:

• I have read and understand this Wellness Amenities Acknowledgment & Assumption of Risk.
• I understand that participation in MOSÉ wellness activities is voluntary.
• I understand that MOSÉ does not provide medical diagnosis or treatment.
• I understand that heat, cold, water, steam, outdoor environments, and related wellness activities involve inherent risks.
• I agree to follow applicable safety and operating instructions.
• I agree to stop using an amenity if I experience concerning symptoms or believe continued use may be unsafe.
• I accept responsibility for determining whether my voluntary participation is appropriate for me.
• I voluntarily assume the ordinary and inherent risks of the wellness activities I choose to participate in, to the extent permitted by applicable law.
