Terms & Conditions

Welcome to MOSÉ — My Own Spa Experience. These Terms & Conditions (“Terms”) govern reservations, stays, use of the property, and use of the services and amenities provided by Vanguard Factory Built LLC d/b/a M.O.S.E. My Own Spa Experience (“MOSÉ,” “we,” “us,” or “our”).

By making or completing a reservation, creating a MY MOSÉ account, checking the required agreement box during checkout, or using the property and its amenities, the person making the reservation (“Guest”) agrees to these Terms and represents that they are authorized to agree to applicable reservation terms on behalf of the other members of their party.

1. THE MOSÉ EXPERIENCE

MOSÉ provides private overnight accommodations and self-directed wellness amenities designed to allow guests to create their own private wellness experience.

Amenities vary by suite and may include infrared sauna, steam, cold plunge, hot tub, wood-fired hot tub, outdoor sauna, outdoor shower, massage equipment, aromatherapy, chromotherapy, sound or wellness programming, and other wellness and hospitality amenities.

MOSÉ is a hospitality and wellness-experience business. MOSÉ does not provide medical diagnosis, medical treatment, medical advice, or emergency medical services.

2. AGE AND OCCUPANCY

During the current operating phase, guests staying in OmniView and Emberspa suites must be at least 18 years old.

Each OmniView or Emberspa suite has a maximum occupancy of three adults unless MOSÉ expressly states otherwise in writing.

The person making the reservation must be at least 18 years old and is responsible for ensuring that all members of the reservation comply with these Terms.

Future MOSÉ accommodations may have different age and occupancy policies.

3. RESERVATIONS

Reservations are subject to availability.

A reservation is not confirmed merely because a guest selects dates or begins checkout.

MOSÉ may temporarily hold accommodations while a guest completes payment. A reservation becomes confirmed only after MOSÉ receives and verifies the required payment and issues confirmation.

Availability, rates, promotions, taxes, fees, and other reservation information may change before a reservation is confirmed.

Confirmed reservations are subject to the terms, rates, promotions, and financial information recorded with that reservation.

4. PAYMENT

Unless MOSÉ expressly offers another payment arrangement, the full amount required for the reservation is due when the reservation is made.

Payments are processed through MOSÉ's third-party payment processor. MOSÉ does not store guests' complete payment-card information in its reservation database.

Guests authorize MOSÉ and its payment processor to collect amounts expressly associated with the reservation and, as permitted by these Terms and applicable law, documented amounts arising from guest-caused property damage, missing property, extraordinary cleaning, or other authorized charges.

5. RATES, TAXES AND FEES

Nightly rates may vary based on suite type, day of the week, promotional eligibility, length of stay, and other disclosed pricing rules.

Applicable taxes and fees are displayed during checkout.

MOSÉ currently does not charge a separate cleaning fee.

A resort fee may be established by MOSÉ. When that fee is waived, the reservation may display the fee as $0.00 or “Waived.”

Optional products, food, merchandise, services, packages, pet fees, or other add-ons may have separate tax treatment.

6. CHECK-IN AND CHECKOUT

Check-in: 3:30 PM
Checkout: 12:00 PM

Unless MOSÉ approves an exception, guests must comply with these times so the suite can be prepared properly for arriving guests.

Early arrival or late checkout is not guaranteed.

7. CANCELLATIONS

MOSÉ's separate Cancellation & Refund Policy forms part of these Terms.

For standard reservations, a guest is eligible for a full reservation refund when MOSÉ receives the cancellation request before the beginning of the three full calendar days immediately preceding the scheduled check-in date, measured according to the property's local Central Time.

For example, for a Friday check-in, Tuesday, Wednesday, and Thursday are the three full calendar days immediately preceding check-in. The cancellation deadline is therefore Monday at 11:59 PM Central Time.

Cancellation requests received after the applicable deadline are not eligible for a standard refund except where MOSÉ determines otherwise or applicable law requires otherwise.

8. NO-SHOWS AND EARLY DEPARTURES

Failure to arrive for a confirmed reservation without timely cancellation is considered a no-show.

No-shows are nonrefundable.

If a guest voluntarily leaves before the scheduled checkout date, unused nights are nonrefundable unless MOSÉ determines otherwise or applicable law requires otherwise.

9. MODIFICATION REQUESTS

Reservation modification requests are subject to availability and MOSÉ approval.

Submitting a modification request does not automatically change a reservation.

The existing reservation remains in effect until MOSÉ confirms a modification.

Changes may affect rates, promotional benefits, taxes, fees, or availability.

10. VIP INAUGURAL BENEFIT

Eligible verified MOSÉ VIP customers may receive a one-time inaugural reservation benefit during the promotional period established by MOSÉ.

For qualifying reservations of at least two consecutive nights:

  • Night 1 is charged at the applicable nightly rate.
  • Night 2 is complimentary.
  • Nights 3 and beyond receive 25% off the applicable nightly rate.

Applicable weekday pricing adjustments are calculated before the VIP promotional benefit.

A one-night VIP reservation does not qualify for the complimentary second night and does not, by itself, consume the guest's one-time qualifying inaugural benefit.

The inaugural benefit may be used only once per eligible VIP customer unless MOSÉ expressly authorizes otherwise.

If a reservation using the benefit is cancelled or refunded, reinstatement of the benefit is not automatic. MOSÉ will review the circumstances and determine whether eligibility should be restored.

VIP benefits have no cash value and may not be sold or transferred unless MOSÉ expressly authorizes the transfer.

11. HISTORICAL $50 VIP PAYMENTS

Certain MOSÉ VIP customers previously paid $50 in connection with VIP membership or early access.

A historical $50 payment is not automatically treated as reservation credit.

Depending upon the customer's original arrangement and MOSÉ's records, the payment may be classified as:

  • membership or access only;
  • available reservation credit; or
  • previously redeemed.

When an eligible $50 reservation credit exists, it will be reflected in the customer's account or reservation and applied according to MOSÉ's reservation system.

12. PETS AND OTHER ANIMALS

MOSÉ permits pets subject to the following requirements:

  • No more than two pets are permitted in a suite.
  • Guests must notify MOSÉ in advance that they intend to bring a pet.
  • MOSÉ may request photographs of ordinary pets before the stay.
  • A $75 pet fee applies to ordinary pets.
  • Pets may not roam freely around the property.
  • Outside the guest's private accommodation or designated private area, pets must be appropriately controlled and leashed where applicable.
  • Guests are responsible for supervising their animals, cleaning up after them, and preventing excessive noise, nuisance, property damage, or interference with other guests.

Guests are responsible for damage caused by their pets.

Service Animals

Legally protected service animals are not treated as pets. MOSÉ will accommodate service animals as required by applicable law.

MOSÉ does not impose its ordinary pet fee solely because a guest uses a qualifying service animal.

Where permitted by law, MOSÉ may ask the limited questions permitted for determining whether an animal qualifies as a service animal.

A service animal must remain under the handler's control as required by applicable law.

Guests remain responsible for damage actually caused by a service animal to the same extent MOSÉ would charge other guests for comparable damage.

13. SMOKING AND VAPING

Smoking is prohibited in MOSÉ accommodations and on the MOSÉ property.

Vaping is prohibited inside all accommodations and indoor areas. Vaping is permitted only outdoors in areas where doing so does not create a hazard, nuisance, or interference with other guests.

Guests are responsible for documented remediation, cleaning, repair, or other reasonable costs caused by violation of this policy.

14. ALCOHOL

Guests of legal drinking age may possess and consume alcohol in accordance with applicable law and MOSÉ property rules.

Guests are responsible for their own alcohol consumption and conduct.

Alcohol consumption does not excuse unsafe use of wellness amenities, property damage, disruptive behavior, violation of these Terms, or conduct that endangers the guest or others.

Guests should not use heat, cold, aquatic, or other wellness amenities when alcohol consumption makes doing so unsafe.

15. WELLNESS AMENITIES AND PERSONAL RESPONSIBILITY

Use of MOSÉ wellness amenities is voluntary.

Heat exposure, cold exposure, hot tubs, saunas, steam rooms, cold plunges, outdoor wellness equipment, massage equipment, wet surfaces, and similar activities involve inherent risks.

Guests are responsible for evaluating whether they can safely use an amenity.

Guests should carefully follow posted instructions, safety information, operating instructions, time limitations, temperature guidance, and MOSÉ staff instructions.

Guests should immediately stop using an amenity if they feel dizzy, faint, confused, excessively hot or cold, short of breath, ill, uncomfortable, or otherwise concerned about their physical condition.

Individuals who are pregnant, have cardiovascular conditions, blood-pressure concerns, neurological conditions, impaired temperature regulation, take medications that may affect heat or cold tolerance, or have another medical condition that could affect safe use should consult an appropriate medical professional before using potentially strenuous, heat-based, cold-based, aquatic, or similar amenities.

MOSÉ does not determine whether any particular wellness practice or amenity is medically appropriate for an individual guest.

Additional wellness acknowledgment and assumption-of-risk terms may be required before use of certain amenities.

16. PROPERTY DAMAGE

Guests are responsible for damage they or members of their party cause beyond ordinary wear and tear.

MOSÉ may charge the payment method associated with the reservation, to the extent permitted by applicable law and applicable payment-processing rules, for reasonable and documented costs associated with guest-caused damage, missing property, repair, replacement, remediation, or extraordinary cleaning.

MOSÉ strongly encourages guests to report accidental damage immediately.

Communication early and often is important.

When a guest promptly reports accidental damage and cooperates with MOSÉ, MOSÉ may, in its discretion and depending on the circumstances, reduce or waive some or all of the resulting charge.

Failure to report damage may result in the guest being responsible for the full reasonable and documented cost of addressing the damage.

Nothing in these Terms eliminates rights that cannot legally be waived.

17. GUEST CONDUCT

Guests must use MOSÉ accommodations and amenities responsibly and in a manner that does not endanger people, animals, property, or the peaceful enjoyment of other guests.

Illegal activity, threatening behavior, intentional property damage, dangerous misuse of equipment, and material interference with other guests or MOSÉ operations are prohibited.

MOSÉ may require a guest to discontinue unsafe conduct or leave the property when reasonably necessary to protect people or property, subject to applicable law.

18. WEATHER, UTILITY INTERRUPTIONS AND EVENTS OUTSIDE MOSÉ'S CONTROL

MOSÉ is located in the Texas Hill Country and may be affected by severe weather, utility interruptions, road conditions, wildfire risk, government orders, natural events, or other circumstances outside MOSÉ's reasonable control.

When such circumstances materially prevent MOSÉ from providing the reserved accommodation or make occupancy unsafe, MOSÉ may, depending on the circumstances, offer rescheduling, reservation credit, refund, or another reasonable accommodation.

When the property remains safely available but a guest independently decides not to travel, the standard Cancellation & Refund Policy generally applies.

MOSÉ retains reasonable discretion in evaluating exceptional circumstances, subject to applicable law.

19. AMENITY AVAILABILITY

MOSÉ works to maintain its accommodations and wellness amenities in operating condition.

Individual amenities may occasionally be temporarily unavailable because of maintenance, safety concerns, weather, repair, sanitation, or circumstances outside MOSÉ's reasonable control.

MOSÉ will make reasonable efforts to communicate material changes affecting a reservation.

Temporary unavailability of an individual amenity does not automatically entitle a guest to a full refund, although MOSÉ may provide an appropriate adjustment, credit, alternative, or other accommodation depending upon the materiality and circumstances.

20. MY MOSÉ ACCOUNTS

Guests may create a MY MOSÉ account to manage reservation information and view eligible benefits and reservation history.

Guests are responsible for maintaining the confidentiality of their account credentials and for promptly notifying MOSÉ if they believe their account has been compromised.

21. COMMUNICATIONS

Guests authorize MOSÉ to send transactional communications reasonably related to their account, reservation, payment, stay, cancellation, modification, safety, or customer service.

Transactional communications are not marketing subscriptions.

Guests are responsible for providing accurate contact information.

22. THIRD-PARTY SERVICES

MOSÉ uses third-party technology providers to support functions such as payment processing, application infrastructure, authentication, and transactional email delivery.

Use of those services may also be governed by the providers' applicable terms and privacy practices.

23. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, MOSÉ is not responsible for losses resulting solely from a guest's failure to follow safety instructions, misuse of amenities, violation of these Terms, or conduct outside MOSÉ's reasonable control.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

The parties' respective rights remain subject to applicable federal and Texas law.

24. DISPUTE RESOLUTION AND MANDATORY ARBITRATION

IMPORTANT: THIS SECTION REQUIRES INDIVIDUAL BINDING ARBITRATION OF CERTAIN DISPUTES AND SHOULD BE READ CAREFULLY.

Except for claims or remedies that applicable law does not permit the parties to submit to mandatory arbitration, a dispute arising from or relating to a MOSÉ reservation, stay, transaction, these Terms, or the parties' relationship shall be resolved through binding arbitration rather than a trial in court.

Before initiating arbitration, the complaining party must provide the other party written notice describing the dispute and requested resolution and allow at least 30 days for the parties to attempt in good faith to resolve the matter informally.

If the dispute is not resolved, arbitration will be administered by the American Arbitration Association (“AAA”) under the applicable consumer arbitration rules in effect when the arbitration is initiated, unless the parties mutually agree to another arbitration provider or procedure.

The arbitration shall take place in Texas, remotely where appropriate, or at another mutually agreed location, subject to applicable law and applicable arbitration rules.

The arbitrator may award remedies available under applicable law.

Nothing in this provision prevents either party from seeking relief in small-claims court when the claim qualifies and applicable law permits it, or from seeking temporary or emergency judicial relief when necessary to preserve rights or prevent immediate harm pending arbitration.

This arbitration provision is intended to be interpreted and enforced according to applicable federal and Texas arbitration law.

MOSÉ intends this provision to require mandatory individual arbitration where legally enforceable. This section should be reviewed by qualified Texas counsel before public launch.

25. GOVERNING LAW

Except where federal law or another applicable law controls, these Terms and the relationship between MOSÉ and its guests are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

26. SEVERABILITY

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

27. CHANGES TO THESE TERMS

MOSÉ may update these Terms from time to time.

Material changes will apply prospectively unless applicable law permits otherwise.

The version applicable to a reservation will be identified or recorded by MOSÉ so that the terms accepted in connection with the reservation can be determined.
